These Terms of Service (“Terms”) govern your access to and use of the Aetheria website, Discord server, and any pre-release or early-access versions of the Aetheria game or related services (“Services”). By accessing or using any part of the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
Aetheria is under active development. Features, availability, design, and gameplay may change, be removed, or be reset at any time without notice.
You must be at least 13 years old, or the minimum age required in your jurisdiction to use the Services lawfully. If you are under the age of majority in your region, your parent or legal guardian must review and agree to these Terms on your behalf where required by local law. You also agree to comply with the terms of Discord and any other third-party services you use in connection with Aetheria.
You agree not to:
You retain ownership of any worlds, avatars, games, designs, or other content you create or upload through the Services (“User Content”). By uploading or submitting User Content, you grant Aetheria a worldwide, non-exclusive, royalty-free license to host, store, display, distribute, and otherwise make such content available as necessary to operate, improve, and provide the Services. You represent and warrant that you have all rights necessary to submit the User Content and that it does not violate applicable laws or the rights of any third party.
You are solely responsible for the content you create and share. We may remove or restrict content that violates these Terms or creates risk to the community or the Services.
We reserve the right to monitor, review, remove, restrict, mute, suspend, or terminate access to any account or content that violates these Terms, poses a risk to the community, or otherwise interferes with the proper operation of the Services. Enforcement actions may be taken without prior notice where necessary to protect users, infrastructure, or compliance obligations. If you believe a moderation decision was made in error, you may request review through our Discord server.
The Services are provided on an “as is” and “as available” basis. We may modify, suspend, discontinue, or reset features, content, or accounts at any time without prior notice. We do not guarantee uninterrupted access, error-free performance, or preservation of user-generated content. Backups and data retention are not guaranteed.
Except for User Content, all content, materials, and technology provided through the Services—including website design, branding, artwork, source code, documentation, and game assets—remain the property of Aetheria or their respective licensors. You may not reproduce, distribute, sell, or otherwise exploit such materials without prior written permission, except as expressly authorized by these Terms or by an applicable open-source license.
Where we publish code in public repositories, that code is governed by the license applicable to the relevant repository.
To the maximum extent permitted by applicable law, the Services are provided without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability. We do not warrant that the Services will be secure, timely, or free from errors, defects, or interruptions.
To the fullest extent permitted by law, Aetheria, its operators, and affiliated parties shall not be liable for any indirect, incidental, consequential, special, punitive, or similar damages arising out of or related to your use of the Services, including loss of data, loss of profits, business interruption, or reputational harm, even if advised of the possibility of such damages.
Our aggregate liability for any claim arising from the Services shall not exceed the fees, if any, paid by you to access the Services, or, if no fees are paid, an amount determined by applicable law or, if no cap applies, the amount reasonably attributable to the claim.
We may update these Terms from time to time to reflect changes in the Services, legal requirements, or operational practices. Continued use of the Services after such changes become effective constitutes your acceptance of the updated Terms. The “Last updated” date at the top of this page will indicate the effective date of the current version.
If you have questions about these Terms or need to report a concern, please contact us on the Discord.
